In Texas, only certain relatives of the deceased can file a wrongful death claim. These eligible parties include the following:
- The surviving spouse
- The deceased’s children
- The deceased’s parents
- A personal representative of the estate
If you are eligible to file a wrongful death claim, Tex. Civ. Prac. & Rem. Code § 16.003 (2021) gives you two years after your loved one’s death to file the claim. We can help you file a solid claim within the statute of limitations so you don’t miss the opportunity to defend your rights.
